BORNEO TOUR SPECIALISTS ONLINE SERVICE TERMS AND CONDITIONS
GENERAL BOOKING CONDITIONS
RESPONSIBILITY: Borneo Tour Specialists and operators of the tour on which you are booked, act only as agents for the airlines, transportation companies, hotel owners or contractors and other principals, and all tickets, exchange orders, vouchers and documents are issued subject to the conditions under which such transportation, accommodation and other contractors operate. By the acceptance of any documentation, the purchaser and/or tour member agrees that neither Borneo Tour Specialists, its employees or associated companies/agents shall be or become responsible for any injury, damage, accident, loss, delay or irregularity that may be caused to a person or property or otherwise in connection with any accommodation, transportation or any other service included in your tour. This will also apply for any reason resulting directly or indirectly from Acts of God, dangers incidental to the sea or terrain, machinery breakdown, hostilities, riots, strikes, civil commotion, thefts, sickness, evacuation, quarantine, immigration, medical or customs regulations, improper or insufficient passports or other documentation or cancellations in itinerary or schedules or from any cause beyond the control of Borneo Tour Specialists, its employees or associated companies/agents. Borneo Tour Specialists, its employees or associates shall not be or become liable for any additional expenses or liability sustained or incurred by a tour member as a result of any of the foregoing. Borneo Tour Specialists, its employees or associated companies/agents reserve the right to alter or modify itineraries, accommodation and transportation in any way necessary in the interest of tour members or due to circumstances beyond their control. Borneo Tour Specialists, its employees or associated companies/agents do not accept any liability for failure on the part of transportation companies whose responsibility is confined to their own operations. Borneo Tour Specialists reserves the right to cancel or withdraw at any time, bookings made by or for the client, in which event no liability whatsoever shall be attributed to Borneo Tour Specialists, its employees or associated companies/agents and furthermore while taking every care with passenger’s property, shall not be liable for any loss, damage or inconvenience in the handling thereof.
The transportation firm or companies shall be exempt from all liability in respect of any detention, delay, loss, damage, sickness, or injury however or whosoever caused and of whatever kind occurring of or to the passenger at any time when the passenger is not on board a carrier or conveyance used and operated by the transport companies and firms. The passage contract in use by the transportation companies shall constitute the sole contract between the transportation companies and firms and the purchaser of a tour and/or passengers.
BOOKINGS & DEPOSITS: A non-refundable deposit of $A200.00 is required to confirm your place on the trip. Final payment is due 30 days prior to departure, or earlier when advised at the time of booking. If booking is made less than 30 days prior to departure, full payment is required immediately. Bookings made within two weeks (14 Days) of departure will incur a $A35.00 per person administration fee.
TRAVEL DOCUMENTS: Each person requires a valid passport. Information relating to visa requirements will be advised at the time of booking as this varies according to nationality and length of stay. Your passport needs to have at least 6 months validity at time of travel.
HEALTH REQUIREMENTS: Vaccinations are not normally, however, a course of anti-malarial tablets may be necessary, depending on your destination (particularly to areas within Sabah and Kalimantan). You should check with your local family doctor. For passengers joining adventure/trekking trips, please ensure that your tetanus vaccination is current. Borneo Tour Specialists accepts no responsibility for any diseases or infections with which you may become infected as a result of a trip to Borneo
BAGGAGE: Allowance is limited to 20 kilograms per person plus a day pack or cabin bag. If you are a diver and require more than the 20 kg allowance, please advise us at time of booking. On itineraries which include flights by light aircraft/charters, (e.g. Miri to Mulu) baggage allowance is limited to 10 kg per person plus one piece of hand luggage. Excess baggage may be permitted by the airline at additional charge. While every care is taken with baggage, no responsibility can be accepted for any loss, damage or delay. Baggage insurance is recommended.
INSURANCE: is not included in the trip cost and it is mandatory that you purchase a personal travel insurance policy to cover cancellation, sickness, accident, and evacuation, and in the case of adventure trips – search and rescue cover. Your agent or Borneo Tour Specialists will be able to suggest a suitable insurance package.
TRIP NOTES: On receipt of deposit you will be sent trip notes which provide further information on suggested clothing, equipment, visa and health requirements.
TOUR PRICE DOES NOT INCLUDE: Excess baggage charges, cost of passports, visa fees, laundry charges, meals not specified as being included, airport taxes (except Australia), drinks, insurance premiums, telephone charges or any other personal expenses incurred by the trip participant. Trip costs include all planning and operational costs and the cost quoted represents a complete package.
AMENDMENTS: You may extend or modify most trips provided you comply with the rules of the airfare type used. Any change to international flights must be made prior to tickets being issued. Amendment after confirmation will incur a fee of $A50.00 per person. Postponement of a trip is treated as a cancellation and not an amendment.
CANCELLATIONS: Deposits are non-refundable. For cancellations received less than 30 days prior to departure, cancellation fee will be a minimum of 50% of land and air component plus any additional charges made by operators. You are urged to take insurance cover as protection in case of inability to travel due to illness.
REFUNDS: Generally no refund will be made when a passenger changes itinerary after the trip has commenced. Any request for a refund must be received by Borneo Tour Specialists in writing within 30 days after completion of the trip.
AIRFARES: Between Australia and Kuala Lumpur are based on individual tour and IT fares which carry cancellation penalties after tickets have been issued.
AIR TRAVEL: The tours are operated by Borneo Tour Specialists in conjunction with Malaysian, Brunei, and Indonesian hotels, local ground transport firms and villages and communities within those countries. The services of any airline may be used, however, the preferred airline for the tours is Malaysia Airlines for International flights and Malaysian domestic flights within Sabah and Sarawak. Borneo Tour Specialists will automatically book ALL flights from and to the nominated trip joining point.
ALTERATIONS: Prices and schedules are subject to change. All rates are quoted in Australian Dollars and based on tariffs, airfares and exchange rates as at 01 December, 2005 and are subject to adjustment. The right is reserved to substitute aircraft, date of departure, accommodation or routing of any land or air component of these trips. The right is reserved to decline to accept or retain at any time any person as a trip participant.
